The Fall
The client worked as a machine operator at a manufacturing and production plant, placed through a temporary staffing agency, in the Illinois area.
In August 2022 she slipped and fell at work. Pain hit her right knee and lower back immediately.
Serious Injuries — and a Stalled Claim
Imaging revealed real damage: in her back, a lumbar disc herniation at L5-S1 with radicular symptoms (pain radiating down the leg); in her right knee, a medial meniscus tear. She received therapy, pain management, and lumbar epidural injections.
Then the obstacles piled up. The insurer disputed causation, arguing part of the damage was “degenerative” and pre-existing. They contested the scope of injury, future treatment, and the medical bills. Worst of all, they stopped paying her disability benefits. And her case had come from a prior attorney where it was no longer moving forward.
She was injured, unpaid, and stuck.
Turning Strategy Into Justice
When the client came to our office, our legal team took over the case immediately.
We filed a Section 19(b)/8(a) petition for an immediate hearing over the unpaid benefits, so the insurer could not keep leaving her without income. We assembled the full record — the MRI, the knee and back notes, the injections — and showed the injuries came from the fall, not from “something old.”
Jack Epstein, with 30 years of experience in the Illinois legal market, oversaw the strategy. We pressed every disputed point: the knee, the back, the unpaid benefits, the treatment, and the medical bills. Throughout, the client paid nothing until we won the case.
The Result
The client secured an $85,000 settlement.
After taking over a stalled case and fighting through every denial, the record confirmed what the client lived: real knee and back injuries born from a workplace fall. Every withheld payment and every doubt, we met with evidence.
Why This Case Matters
A workplace fall that injures the knee and back is compensable — even when the insurer cries “degenerative” and stops paying, and even when a previous attorney let the case stall. You can change attorneys and demand an immediate hearing.
If your benefits have been cut off or your case has stalled, our Illinois legal team can help you recover what you rightfully deserve.
