A Safety Task Ends in Injury
On December 11, 2024, “the client”, a 43-year-old construction professional, was working at a site in Chicago, Illinois. He was performing a standard safety task—installing a fire extinguisher—when the ladder he was using became unstable.
He fell, landing hard and sustaining a significant injury to his left shoulder. In the construction industry, a shoulder injury limits almost every physical movement required to do the job.
The Burden of Paying for Your Own Injury
The aftermath of the accident was chaotic. Initially, the client was left to navigate his recovery alone. He sought treatment from a chiropractor on his own dime, paying out of pocket in hopes of getting back to work.
However, the injury was too severe for basic adjustments. The pain persisted and intensified, eventually requiring hospitalization. Despite the accident happening at work, the client was assuming the medical expenses himself—a financial strain no worker should ever have to bear.
Legal Intervention: Stopping the Bills
When Jack Epstein’s team took the case, our first priority was to shift the financial responsibility back where it belonged: on the employer’s insurance.
We ensured that the client stopped paying for his own care. We secured the necessary medical approvals so he could receive proper treatment without opening his wallet. Furthermore, we established his right to Temporary Total Disability (TTD) benefits. We successfully secured weekly payments for the period he was medically off work (from December 12, 2024, through February 6, 2025), ensuring he had income while he healed.
A Settlement for Permanent Loss
Once his immediate medical and financial needs were met, we focused on the long-term impact of the shoulder injury.
We negotiated a final settlement of $56,250.00. This agreement was calculated based on a 12.5% loss of the person as a whole, acknowledging that the shoulder injury resulted in permanent limitations. The settlement provided approximately 62.5 weeks of compensation at the permanent partial disability (PPD) rate, delivering the justice and financial security the client deserved.
