From Rejection to Resolution
The journey to justice for the injured worker was far from simple. While the pain in her elbows began as a result of grueling, repetitive tasks on a meat production line, the legal and medical hurdles that followed were significant. The employer’s insurance carrier initially created roadblocks, including a medical utilization review that denied specific medications and delayed essential surgical intervention.
For months, the injured worker was left in a state of uncertainty, managing persistent pain while the insurance company scrutinized every aspect of her medical necessity. This period of delay is a common tactic used to pressure workers into accepting low-value settlements, but our firm remained steadfast in demanding the full scope of benefits required for her recovery.

Inside the Industrial Accident
The client was a 47-year-old factory worker dedicated to her role in a food production facility in Marengo, Illinois. Her daily responsibilities required high-intensity repetitive movements, specifically pushing and pulling large quantities of meat from conveyor belts. By February 2023, the physical strain became unbearable, manifesting as severe pain in both elbows.
Medical evaluations eventually confirmed a diagnosis of lateral epicondylitis (commonly known as tennis elbow) in both arms, with the right elbow being particularly damaged. Despite the clear link between her industrial duties and her physical decline, the path to receiving proper care was blocked by bureaucratic denials and a refusal by the employer to accommodate her increasing physical limitations.
Turning Strategy Into Justice
Jack Epstein, with 30 years of experience in the Illinois legal market, recognized that this case required an aggressive litigation strategy. After the insurance company presented an Independent Medical Examination (IME) that falsely claimed the injury was merely a “temporary aggravation,” our legal team filed a formal response to discredit those findings. We argued that the worker had not reached maximum medical improvement and required advanced surgical care.
Our firm filed an Application for Adjustment of Claim and moved for immediate hearings under Section 19b of the Illinois Workers’ Compensation Act. This legal pressure forced the insurance carrier to finally certify the necessary surgery in 2024. Throughout this process, we ensured the client received Temporary Total Disability (TTD) payments, providing her with a consistent income while she was unable to work.
Settlement That Restored Stability
Following a successful right elbow surgery and an intensive period of work conditioning, a Functional Capacity Evaluation (FCE) was conducted in early 2025. The evaluation determined that the injured worker could only perform “light” category work—a significant shift from the “medium” duty demands of her previous factory position. Because the employer could not provide a role within these new physical restrictions, the worker faced a difficult professional future.
Our legal team entered into intensive negotiations to ensure the final settlement accounted for this loss of vocational capacity. In May 2025, the case was successfully resolved, with the client receiving a settlement check that addressed her permanent limitations and medical journey. This outcome allowed the injured worker to move forward with financial dignity despite no longer being able to return to her previous trade.
