From a Warehouse Fall to Chronic Pain: The Physical Toll

The incident occurred at approximately 2:40 p.m. when the plaintiff fell while working in a warehouse environment. What was initially documented as general low back pain soon evolved into a complex neurological condition.

The medical impact of the fall was extensive:

  • Neurological Damage: Diagnostic studies, including an EMG/NCV, suggested left L4-L5-S1 radiculopathy and diffuse sensorimotor peripheral neuropathy.
  • Chronic Pain Management: The plaintiff required lumbar medial branch blocks and physical medicine treatment.
  • Surgical Recommendation: Specialists documented the need for a lumbar laminectomy, discectomy, or decompression surgery due to persistent vertebrogenic low back pain.
  • Mobility Support: Treatment included the use of a lumbar brace, TENS unit, and various pain medications such as gabapentin and tramadol.

Overcoming Medical Disputes and Denials

The case was characterized by a sharp disagreement between the company’s independent medical examiners (IME) and the plaintiff’s treating physicians.

Legal and medical obstacles included:

  • The “Strain” Argument: An IME evaluator argued that the injury was merely a lumbar strain or contusion and that the plaintiff had already reached maximum medical improvement.
  • Authorization Denied: Recommended surgeries and injections were frequently stalled or pending authorization by the insurance carrier.
  • Employment Status: The employer lacked “light duty” work, forcing the plaintiff to remain off the job without pay for extended periods.
  • Legal Transition: The plaintiff had to navigate a change in legal representation early in the case after his previous counsel moved to withdraw.

Jack Epstein, with 30 years of experience in the Illinois legal market, maintained the pressure of litigation—including scheduling a formal evidence deposition of the treating surgeon—to prove the structural nature of the back injury.

Turning Strategy Into Justice

Our legal team utilized certified medical records and electrodiagnostic evidence to challenge the defense’s narrative that the injury was minor. By organizing all medical billing and negotiating with third-party providers, we prepared the case for a comprehensive resolution.

Settlement That Restored Stability In March 2025, the Illinois Workers’ Compensation Commission approved the final settlement:

  • Total Global Settlement: $59,000.00.
  • Medical Resolutions: Over $3,700.00 was allocated to resolve outstanding bills for imaging, anesthesia, and pharmacy services.
  • Legal Financing: A $20,932.66 payment was made to resolve a legal funding lien that supported the plaintiff during his time away from work.
  • Net Recovery: After all deductions, including attorney fees and costs, the plaintiff received a net check of $20,027.46.

While the plaintiff faced persistent pain and work restrictions that prevented a return to his regular role, this settlement provided the financial closure necessary to move forward. The plaintiff paid nothing until we won the case.
